The "Infrastructure Company for Motorways and Other Federal Highways" (IGA) is to take up its duties in full from January 1, 2021. The sole shareholder is the federal government, represented by the Federal Ministry of Transport (BMVI). In addition, a new higher federal authority, the Federal Highway Code (FBA), will be founded on October 1, 2018. It will be part of the BMVI's business area.

Status quo: responsibility for motorways

The motorways are currently administered by the federal states on behalf of the federal government. So the federal government provides the money, but the states plan, build and operate the highways. The federal government has little influence on how quickly the federal states make progress with the planning for certain projects. The aim of the reform is to view the federal trunk road network as a whole and to manage it more efficiently than before. The federal government's money should land quickly and directly where it is needed most.

Federal-state financial relations require new regulations

On October 14, 2016, the heads of government of the federal and state governments resolved key points with which the financial relations and financial equalization between the federal government and the states should be reorganized from 2020 onwards. The reason was a ruling by the Federal Constitutional Court on November 11, 1999, in which the previous financial equalization was only permitted until 2019.

In the key points for a reform, the heads of government of the federal and state governments agreed, among other things, that the federal government would take over the construction, expansion and maintenance of the motorways from January 1, 2021. For this purpose it was decided to found an infrastructure company for motorways and other federal highways.

On June 1, 2017, the German Bundestag decided in the second and third reading to found an infrastructure company and the Federal Highway Authority. The Federal Council then approved the legislative package.

What tasks will the IGA take on?

According to Paragraph 3 of the Federal Trunk Road Act, the IGA will take on "all tasks related to the construction and maintenance of federal trunk roads". The newly founded limited liability company (GmbH) is responsible for planning, construction, operation, maintenance, financing and asset management from January 2021.

The federal government is the sole shareholder of the IGA. According to the Basic Law, he is also not allowed to sell his company shares. The Federal Ministry of Transport and Digital Infrastructure represents the federal government at the shareholders' meeting. The head office is in Berlin. In addition, there will be ten branches spread across the whole of Germany. The branches are assigned 30 permanent and eleven temporary branch offices to support ongoing projects. In addition, at least 185 operations service locations, 42 telecommunications master offices as well as traffic and tunnel control centers are planned.


What tasks does the Federal Highway Agency have?

One of the main tasks of the FBA from 2021 will be that it is responsible as a hearing and plan approval authority in plan approval procedures for motorway projects. The headquarters will be in Leipzig. In addition, the Federal Highway Agency (FBA) will have up to four additional locations. Three of them have already been determined: Bonn, Giessen and Hanover.


Can the IGA decide on construction projects nationwide?

The IGA cannot build or renovate highways at will. Like the contract administrations, it is bound to the requirement plan for the federal highways, with which the federal government anchors the federal transport route plan in law.

The Requirement plan is an appendix to the "Law on the Expansion of Federal Highways" and is therefore the basis for planning, prioritizing and building federal highways.


How is the IGA financed?

The IGA receives the revenue from the truck toll and later also from the car toll for motorways through the federal budget: money that is earned on the road is also reinvested in the road. If necessary, the IGA will receive further funds from the budget. She is not allowed to take out loans on the market.


Are the states losing all responsibility for federal highways?

No. For the federal highways, it remains with the order management by the federal states. That means: The federal states will continue to plan, build, operate and maintain the federal highways on behalf of the federal government. The federal government will continue to bear the special expenditure for these roads.

At the request of a state, however, the federal highways that are in the area of ‚Äč‚Äčthis state can also be transferred to federal administration and would then be the responsibility of the IGA and the FBA.


Are public-private partnerships still possible?

Yes. However, private individuals may only be involved in the planning, construction, operation, maintenance and financing of motorways or other federal highways if the contract extends to individual projects with a total scope of up to 100 kilometers. Several projects may not be linked to one another.

Private participation in PPP projects that encompass the entire motorway network or the entire network of other federal trunk roads in a country or substantial parts of it is excluded.


What does the reform mean for the employees of the federal states?

Together with the federal states, greater attention will be paid to the concerns of the 15,000 employees in the transition period. The employees of the federal states who were previously responsible for the planning, construction, operation and maintenance of the motorways are to continue the same tasks in the new structures at the FBA and the IGA. The location concept was specially designed so that you can continue to use it at your previous workplace and place of work.
