1. General provisions
1.1. These general terms and conditions regulate the relationship between you and Luxair, Société Luxembourgeoise de Navigation Aérienne SA, a public limited company (société anonyme) established and existing under the law of the Grand Duchy of Luxembourg with its registered office at 25 rue Gabriel Lippmann, L-5365 Munsbach, postal address L- 2987 Luxembourg, registered with the Luxembourg Trade and Companies Register under number B 4109 (hereinafter "Luxair").
1.2. By selecting and / or using the reimbursement voucher, you fully acknowledge these General Terms and Conditions, which were made available to you at the time of selection and by the e-mail with which the reimbursement voucher was sent and also on https: // luxair. lu are visible.
1.3. Luxair agents, employees or representatives are not authorized to change, adapt or cancel any of these terms and conditions.
1.4. The following terms have the meanings set out below, unless the context otherwise requires:
a.Refund Voucher means the digital voucher sent to the customer for a ticket refund if the flight is canceled by Luxair or the customer (in accordance with the terms and conditions of the fare class of the ticket (s) purchased).
The refund voucher is divided into 2 different voucher types:
- Type 1. Luxair refund voucher (hereinafter "Type 1 Voucher");
- Type 2. Luxair flight voucher (hereinafter "Type 2 Voucher").
A type 1 voucher is only granted if the original ticket was paid for in whole or in part with a voucher or a gift card.
A type 2 voucher is only granted under special circumstances and only at Luxair's sole discretion. The method of payment of the original ticket has no effect on the type 2 voucher.
A type 1 voucher is valid for 1 year from the date of issue. It cannot be reimbursed or extended. A type 1 voucher is always issued in the name of the ticket holder.
In the case of a type 2 voucher, Luxair determines the validity of the voucher at its sole discretion, taking into account the special circumstances. Before a type 2 voucher is granted, the designated recipient is clearly informed of its validity.
b.date of issue is the date the voucher, compensation voucher, or refund voucher was originally issued.
c.Expiry Date is the last date the customer can redeem their refund voucher. It is also the last possible flight date. On that date, the refund voucher will expire at the end of the day at 11:59 p.m. UTC.
d.Voucher (s) means the one (s) offered by Luxair Compensation voucher (s) and or Refund Voucher (s).
e.gift card means the prepaid credit card that can be purchased on the https://giftcards.luxair.lu website.
f.Designated recipient is the ticket holder who receives the email with the refund voucher (s) issued.
2.1. The refund voucher is non-refundable. It cannot be paid out in cash or exchanged for other values. The resale of a refund voucher (s) is also not permitted.
2.2. The refund voucher can be used several times within the validity period until the total credit of the refund voucher has been used up in full. After the expiration date, the refund voucher can no longer be used, extended or reactivated; Any unused balance on the refund voucher cannot be claimed or redeemed for cash. Any unused refund voucher amounts will not be refunded or credited.
2.3. A refund voucher cannot be redeemed for the purchase of gift card (s) or any other voucher (s).
3. Redeem your Refund Voucher
3.1. A refund voucher can only be used for online purchases of ticket (s) and ancillary services via the Luxair website https://luxair.lu or via https://luxairtours.lu and in the Luxair mobile phone app. Only the flights available on the websites mentioned can be booked with or without ancillary services, no packages or other individual services.
3.2. The refund voucher can be redeemed up to its expiration date, which is specified in the email that the refund voucher was sent with. The refund voucher will expire on the specified expiration date at 11:59 p.m. UTC.
3.3. The flight must be completed before the expiration date of your refund voucher. The last flight must be commenced by 11:59 p.m. (UTC) at the latest by the expiry date.
3.4. The refund voucher can be redeemed when booking a flight on https://luxair.lu or on https://luxairtours.lu or in the Luxair mobile phone app. Before going to the payment page, you can enter the number and PIN code of the refund voucher in the appropriate fields.
3.5. Vouchers and promo codes cannot be combined as means of payment at the moment.
3.6. The amount of the refund voucher can be used for the entire fare (price and taxes and additional services (if selected)).
3.7. It is currently not possible to add Luxair travel insurance to your booking when using your gift card (s) or voucher (s) to pay.
3.8. When paying with the refund voucher, the refund voucher will be used in full if the booking amount equals or exceeds the available credit. Therefore, the entire transaction payment should be made using the refund voucher. If the purchase exceeds the redeemer's refund voucher balance, the balance must be paid using another accepted means of payment: credit card (Visa, MasterCard and American Express) or other accepted gift card (s) and / or voucher (s).
If there is any credit left after your transaction, the value of the compensation voucher (s) or gift card (s) will be adjusted and will remain valid on the same terms (no refund or renewal possible).
3.9. You can use up to three forms of payment for a purchase and combine (a) compensation voucher (s), (a) gift card (s) and (an) accepted credit card (s).
3.10. For technical reasons, a payment with the refund voucher cannot be combined with PayPal payment at the moment.
3.11. Air tickets paid for in whole or in part with voucher (s) or gift card (s) are non-refundable. If the flight is canceled by Luxair or the customer (in accordance with the terms and conditions of the fare class of the ticket (s) purchased), a new refund voucher will be issued.
4. Liability and Risk of Loss
4.1. The risk of loss and ownership of the reimbursement voucher are transferred to the designated recipient when we electronically transmit the reimbursement voucher.
4.2. Luxair is not responsible if a refund voucher is lost, stolen, destroyed or used without the consent of the recipient. Neither Luxair nor any of Luxair's agents, employees or representatives are required to require identification from any person presenting this Refund Voucher.
4.3. Luxair assumes no liability if the email address of the designated recipient of the refund voucher is misspelled.
5. Other provisions
5.1. Luxair reserves the right to adapt these General Terms and Conditions at any time and in any other way at its sole discretion. These adjustments or changes will not affect any refund vouchers that have already been issued.
5.2. These general terms and conditions represent all agreements between Luxair and you and replace all previous (oral or written) agreements and arrangements on the subject matter of the contract.
5.3. Failure by Luxair to exercise any of its rights will not be deemed to be a waiver of future exercise of that right, so that your obligations with regard to the future exercise of that right will remain in full effect.
5.4. If any of the clauses in these Terms and Conditions is found to be ineffective, unenforceable or unlawful in any jurisdiction, this will not affect the validity and enforceability of any other clause in these Terms and Conditions or the same clause in any other jurisdiction. In such cases, you and Luxair agree to replace the invalid, unenforceable or unlawful clause in question with a valid and enforceable clause of the same meaning.
5.5. These terms and conditions are written in English. If translated into a language other than English for any purpose, in the event of any dispute, question or dispute as to the meaning, form, validity or interpretation of these Terms and Conditions, the English version will prevail.
5.6. These general terms and conditions are subject to Luxembourg law. As far as legally permissible, you agree that the Luxembourg courts have exclusive jurisdiction for any legal disputes arising from or in connection with these General Terms and Conditions.
